GENERAL TERMS AND CONDITIONS ONLINE SHOP STEWO INTERNATIONAL AG
§ 1 Scope of application and definitions
For the business relationship between Stewo International AG, Entlebucherstrasse 38, 6110 Wolhusen, Switzerland (hereinafter "Seller") and the customer (hereinafter "Customer" or "You") for transactions in the Online Shop (hereinafter "Online Shop"), the following General Terms and Conditions (hereinafter "GTC") shall apply exclusively in the version valid at the time of the respective order. The seller's offer in the online shop is directed at customers with billing and delivery addresses in Switzerland. The inclusion of general terms and conditions or other contractual conditions of the customer that deviate from these terms and conditions will be rejected, unless these are expressly recognized in writing by the seller.
§ 2 Conclusion of contract
The customer can select products from the seller's assortment and add them to the shopping cart. The customer can view and change the order data via the shopping cart symbol at the top right of the screen. As soon as the customer clicks on "Check out" during the ordering process, he makes a binding offer to purchase the goods in the shopping basket at that time (hereinafter "Order"). After placing the order, the customer receives an automatic confirmation of receipt by e-mail, which summarises the contents of the customer's order. This automatic confirmation of receipt does not represent an acceptance of the order, but merely documents that the order has been received by the seller. The Seller may accept the Customer's order within a period of 10 working days after placing the order by e-mail to the Customer (hereinafter referred to as "Declaration of Acceptance"). The contract is concluded upon receipt of this declaration of acceptance by the customer. If the order comprises several articles, the contract is only concluded for those articles which are expressly listed in the declaration of acceptance. The above also applies if the customer has already paid or instructed payment of the purchase price prior to conclusion of the contract. Should the contract not be concluded in this case, the seller will inform the customer immediately (in case of partial acceptance of the contract together with the declaration of acceptance for the deliverable items) and refund the advance payment immediately. The contract is concluded in English. The customer is obliged to fill in the fields provided in the order form completely and truthfully.
§ 3 Delivery conditions
Unless otherwise agreed, delivery shall be made to the delivery address specified by the customer. Delivery will only take place within Switzerland. A self-collection and the delivery to packing stations is not possible. The seller shall inform the customer of the delivery period in the course of the ordering process and in the dispatch confirmation. The indicated delivery times are assumptions. Deviations may occur.
§ 4 Prices and shipping costs
All prices quoted in the online shop are in Swiss francs and include the applicable statutory value-added tax. Errors in prices are reserved. The dispatch of the ordered commodity takes place exclusively within Switzerland. The costs for dispatch and packing amount to CHF 8.90, regardless of size and weight.
§ 5 Methods of payment
The seller only accepts the payment methods PayPal and credit card displayed to the customer during the ordering process. Credit card payments are handled by Stripe. When placing the order, the customer transmits the credit card data. After the legitimation as a legitimate cardholder, the payment transaction is automatically carried out by the credit card company immediately after the order has been placed. If payment is made via PayPal, the customer is forwarded to the website of the online provider PayPal during the ordering process. In order to be able to pay the invoice amount via PayPal, the customer must be registered there or register first. After placing the order in the shop, the seller requests PayPal to initiate the payment transaction. The payment transaction is carried out automatically by PayPal immediately afterwards. Invoices are created electronically and provided in PDF format as an attachment to the shipping confirmation.
§ 6 Retention of title
The goods remain the property of the seller until full payment of all claims of the seller arising from the business relationship.
§ 7 Damages in transit
If goods with obvious transport damages are delivered, the customer has to report this immediately to the seller.
§ 8 Right of revocation
The customer has the right to revoke the contract concluded via the online shop within ten days without giving reasons. The revocation period is ten days from the day on which the customer has received the goods (or, in the case of an order, the order confirmation).
